Terms of Service
1. Acceptance of Terms
By accessing or using any service operated by Quibit, Inc. ("the Company", "we", "us", "our") — including Quibit, Kha, QuiTalk, and QuizCoin (collectively, the "Platform" or "Services") — you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use any of our Services.
These Terms constitute a legally binding agreement between you and Quibit, Inc. By creating an account, accessing content, using any feature, or interacting with any of our four applications, you acknowledge that you have read, understood, and agree to be bound by these Terms.
These Terms include mandatory arbitration and class action waiver provisions that affect your legal rights. They apply to ALL Quibit, Inc. applications: Quibit, Kha, QuiTalk, and QuizCoin. Please read them carefully.
1.1 Our Applications
These Terms apply to the following applications, all operated by Quibit, Inc.:
- All-in-one social platform for Myanmar diaspora community
- Features: news feed, posts, blogs, job listings, business directory, real estate, chat, channels, map, search
- Available on iOS, Android, and web
- Dating and social connection app for Myanmar community
- Features: profile matching, photo sharing, messaging, video calls
- Age requirement: 18+ only (no exceptions)
- Intelligent chat application with advanced AI features
- Features: AI chat assistant, AI channels, AI business chat, rich user profiles, international phone calling to Myanmar
- AI features provide informational responses only — not professional advice
- Educational quiz and gaming platform
- Features: quiz challenges, leaderboards, virtual currency (QuizCoins), achievements, in-game chat
- Virtual currency has no real-world monetary value
1.2 Eligibility
You must meet the following age requirements to use our Services:
Quibit: 13 years or older (under 18 requires parental consent)
Kha: 18 years or older — strictly enforced, no exceptions
QuiTalk: 13 years or older (under 18 requires parental consent; AI features may have additional age restrictions)
QuizCoin: 13 years or older (under 18 requires parental consent)
You must have the legal capacity to enter into these Terms
You must not be barred from using the Services under applicable law
You must not have been previously banned or removed from any Quibit, Inc. service
For users under 18, see our Child Safety Policy for additional protections and parental controls.
1.3 Account Creation and Security
To access certain features, you must create an account. A single Quibit, Inc. account may be used across all four applications. When creating an account:
Provide accurate, current, and complete information
Maintain and update your information to keep it accurate
Keep your password secure and confidential
Enable two-factor authentication (strongly recommended)
Notify us immediately of any unauthorized account use
You are responsible for all activities under your account across all apps
Do not share your account credentials with anyone
Do not create multiple accounts to evade enforcement actions
2. User Conduct and Prohibited Activities
You agree to use all Quibit, Inc. Services in compliance with applicable laws and these Terms. The following activities are strictly prohibited across ALL applications:
2.1 Prohibited Content
- Content that violates local, state, national, or international law
- Content that infringes intellectual property rights
- Child Sexual Abuse Material (CSAM) — see our Child Safety Policy for zero-tolerance details
- Content promoting terrorism or violent extremism
- Drug trafficking, weapons sales, or illegal services
- Hate speech, harassment, or bullying
- Threats of violence or incitement to violence
- Content promoting self-harm or suicide
- Non-consensual intimate imagery (revenge porn)
- Misinformation that could cause imminent harm
- Doxxing or sharing private information without consent
- Scams, phishing, or fraudulent schemes
- Impersonation of others or misrepresentation of identity
- Fake job offers, visa scams, or recruitment fraud targeting Myanmar workers
- Pyramid schemes or multi-level marketing disguised as opportunities
- Counterfeit goods or services
2.2 Prohibited Activities
Accessing others' accounts without permission
Collecting user data through automated means (scraping, crawling)
Interfering with or disrupting the Services or servers
Reverse engineering or attempting to extract source code
Bypassing security measures or access restrictions
Using the Services for unauthorized commercial purposes
Creating multiple accounts to evade enforcement actions
Using bots, scripts, or automation without authorization
Exploiting bugs or vulnerabilities for personal gain (report them instead)
Circumventing geographic restrictions or sanctions
2.3 App-Specific Conduct Rules
In addition to the general rules above, each app has specific conduct requirements:
- Only use real, recent photos of yourself
- Do not create fake profiles or catfish others
- Do not use Kha for solicitation, escort services, or commercial sex
- Respect others' boundaries — stop contacting someone who asks you to stop
- Do not share intimate images received in private conversations
- Report any users who appear to be underage immediately
- Do not attempt to manipulate AI to produce harmful, illegal, or inappropriate content
- Do not use AI features to generate spam, misinformation, or deceptive content
- Do not use AI-generated content to impersonate real people
- Do not harass others via phone calls or messaging
- Channel owners must maintain appropriate content standards in their channels
- Do not use AI business features to deceive or scam customers
- International phone calls must not be used for harassment, threats, or illegal purposes
- Do not cheat, use exploits, or manipulate quiz scores
- Do not use bots or automated tools to earn QuizCoins
- Do not sell, trade, or transfer QuizCoins outside the platform
- Do not harass other players in game chat or leaderboards
- QuizCoins have no real-world monetary value and cannot be exchanged for cash
3. AI Features and Services (QuiTalk)
QuiTalk provides AI-powered features including an AI chat assistant, AI-enhanced channels, and AI business chat. By using these features, you agree to the following additional terms:
AI features are provided for informational and entertainment purposes only. AI responses should NOT be relied upon as professional medical, legal, financial, immigration, or other expert advice. Always consult qualified professionals for important decisions.
3.1 Nature of AI Services
Our AI features are powered by third-party AI models and proprietary technology. You understand and agree that:
AI responses may contain inaccuracies, errors, or outdated information
AI does not have access to real-time information unless specifically provided
AI cannot verify facts, make medical diagnoses, provide legal counsel, or give financial advice
AI responses do not represent the views or opinions of Quibit, Inc.
AI is a tool to assist you — not a substitute for human judgment
AI conversations may be reviewed for safety and quality improvement purposes
3.2 AI Data Usage
When you use AI features, we collect and process conversation data as follows:
AI conversations are stored to provide conversation history and context
Conversation data may be used to improve AI response quality and safety
Your personal data is not used to train third-party AI models
AI conversation data is subject to our Privacy Policy and Data Security Policy
You may delete your AI conversation history at any time in Settings
Channel AI brain content is moderated for safety and appropriateness

3.3 AI Profile & Recommendation System
To enhance your experience, your profile information is automatically shared with our AI system (Qui AI) to provide personalized recommendations, profile matching, and contextual suggestions. By using our services, you agree that:
Your profile data (name, bio, interests, activity history, and preferences) is processed by Qui AI to generate personalized recommendations
AI-powered matching uses your profile to suggest relevant users, channels, content, and business services
Profile sharing with Qui AI is automatic and integral to the service — disabling it would significantly limit core features
Qui AI may analyze your interaction patterns to improve recommendation accuracy over time
Your profile data used for AI recommendations is not shared with other users beyond what you have made publicly visible
You can manage your recommendation preferences in Settings > Privacy > AI Recommendations
AI-generated recommendations are suggestions only — they do not guarantee compatibility, quality, or suitability
Qui AI processes profile data solely to enhance your experience. Your data is not sold to third parties or used to train external AI models.
3.4 AI Channels
QuiTalk allows users to create channels enhanced with AI capabilities (Channel Brain). Channel owners and users agree:
Channel owners are responsible for their channel's AI brain content (FAQ, tone, topics)
AI responses within channels reflect the channel's configured personality and knowledge
Channel brain content is reviewed by our moderation team for safety
AI cannot provide professional advice through channels (medical, legal, financial)
Channel AI may be disabled by Quibit, Inc. if it violates our policies
Users interact with channel AI at their own discretion
3.5 AI Business Agent & Channel Commerce
Business channels on QuiTalk are integrated with Qui AI to provide an intelligent business agent experience. When businesses share products, items, jobs, or services within their channels, the AI acts as a virtual agent to assist customers:
- Businesses list their products, services, job postings, and offers within their QuiTalk channel
- Qui AI automatically indexes and understands all business offerings shared in the channel
- Users can ask Qui AI to summarize available products, compare items, check availability, or get detailed information
- Qui AI responds based on the business's published information — acting as a virtual shop assistant or agent
- Users can initiate transactions, inquiries, or bookings through the AI agent conversation
- The AI agent facilitates the interaction until the business owner reviews and confirms the request
- Business owners must keep their channel product/service information accurate and up to date
- All pricing, availability, and descriptions shared in channels must be truthful
- Business owners are responsible for reviewing and confirming AI-facilitated customer requests in a timely manner
- AI-facilitated interactions do not create binding agreements until the business owner explicitly confirms
- Businesses must not use the AI agent to deceive customers about product quality, availability, or pricing
- AI agent responses are based on business-provided information and may not reflect real-time inventory or availability
- Always wait for business owner confirmation before considering any transaction final
- Quibit, Inc. is not a party to transactions between customers and businesses — we provide the AI communication platform only
- Disputes between customers and businesses should be resolved directly between the parties
- Customer data shared during AI business agent conversations is subject to our Privacy Policy
The AI Business Agent is a communication assistant — not a seller, merchant, or financial intermediary. Quibit, Inc. does not guarantee the quality, accuracy, or fulfillment of any business offerings presented through the AI agent.
3.6 AI Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIBIT, INC. IS NOT LIABLE FOR ANY DAMAGES, LOSSES, OR HARM ARISING FROM YOUR RELIANCE ON AI-GENERATED CONTENT, INCLUDING BUT NOT LIMITED TO:
Inaccurate or misleading AI responses
Decisions made based on AI suggestions or information
Financial losses from following AI-generated advice
Health consequences from AI-provided health information
Legal consequences from AI-provided legal information
Immigration or visa decisions influenced by AI responses
Business losses from AI business chat interactions
4. International Phone Calling (QuiTalk)
QuiTalk provides international phone calling services, primarily for calling Myanmar numbers from abroad. By using this feature, you agree to the following terms:
4.1 Service Description
VoIP-based international calling to Myanmar numbers (mobile and landline)
Requires prepaid wallet balance (see Wallet Terms for details)
Current rate: ₩100 per minute (subject to change with 30 days notice)
Available from any country with internet connection
Supports all Myanmar carriers: MPT, Mytel, Ooredoo, Atom
4.2 Calling Rules and Restrictions
Calls must not be used for harassment, threats, or intimidation
Calls must not be used for illegal purposes (fraud, scams, extortion)
Calls must not be used for commercial telemarketing without authorization
Calls are not recorded by Quibit, Inc. — we do not monitor call content
Call metadata (duration, timestamps, numbers) is retained per our Privacy Policy
Abuse of calling features will result in account suspension
4.3 Service Quality Disclaimer
International calling quality depends on multiple factors beyond our control:
Your internet connection quality and speed
Recipient's mobile network quality in Myanmar
Network congestion during peak hours
Infrastructure availability in remote areas of Myanmar
Third-party VoIP provider performance
We do not guarantee uninterrupted, error-free, or high-quality call service at all times. See our Wallet Terms for billing details, refund policy, and balance expiration rules.
5. Content and Intellectual Property
5.1 Your Content
You retain ownership of content you post on any Quibit, Inc. service ("User Content"). By posting content, you grant Quibit, Inc. a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, distribute, and display your content in connection with operating and improving the Services.
This license ends when you delete your content, except where content has been shared with others and they have not deleted it, or where we need to retain it for legal or safety purposes.
5.2 AI-Generated Content Ownership
Content generated by AI features in QuiTalk is subject to the following:
AI-generated responses are provided as a service and are not owned by you or by Quibit, Inc.
You may use AI-generated content for personal, non-commercial purposes
You may not claim AI-generated content as exclusively your own original work
You are responsible for how you use and share AI-generated content
AI-generated content may be similar to content generated for other users
You must not use AI-generated content in ways that violate these Terms or applicable law
5.3 Quibit's Intellectual Property
All aspects of our Services, including apps, websites, logos, features, and functionality, are owned by Quibit, Inc. and protected by copyright, trademark, and other intellectual property laws. You may not:
Copy, modify, or create derivative works of any Quibit, Inc. application
Use our trademarks (Quibit, Kha, QuiTalk, QuizCoin) without written permission
Remove or alter copyright or trademark notices
Use automated systems to access or extract data from our Services
5.4 Copyright Infringement (DMCA)
We respect intellectual property rights. If you believe content on any Quibit, Inc. service infringes your copyright, submit a DMCA notice to [email protected] with:
Your physical or electronic signature
Identification of the copyrighted work
Identification of the infringing material and its location
Your contact information
A statement of good faith belief
A statement of accuracy under penalty of perjury
6. Privacy and Data
Your privacy is important to us. Our collection and use of personal information across all four applications is governed by our Privacy Policy, which is incorporated into these Terms by reference.
6.1 How We Use Your Data
To provide, maintain, and improve our Services across all apps
To personalize your experience and content recommendations
To facilitate AI conversations and improve AI response quality (QuiTalk)
To process international phone calls and wallet transactions (QuiTalk)
To match users and suggest connections (Kha)
To manage quiz scores, leaderboards, and virtual currency (QuizCoin)
To communicate with you about the Services
To detect, prevent, and address security issues and policy violations
To comply with legal obligations
6.2 Cross-App Data Sharing
Because all four apps share a single account system, some data may be shared across apps:
Your account profile (name, photo, basic info) is shared across apps
Authentication and security data is shared for account protection
Policy violations in one app may affect your access to other apps
You can control app-specific privacy settings independently in each app

7. Financial Terms and Virtual Currency
Certain features across our Services involve financial transactions or virtual items:
7.1 QuiTalk Wallet
QuiTalk provides a prepaid wallet for international phone calling. Key terms:
Wallet is not a bank account and does not earn interest
Minimum top-up: ₩1,000 — Maximum: ₩1,000,000
Balance expires 6 months after last completed call
Refunds available before confirmation only; no refunds after confirmation except for billing errors
Wallet balance is non-transferable between accounts

7.2 QuizCoin Virtual Currency
QuizCoin uses virtual currency called QuizCoins. You understand and agree:
QuizCoins are virtual items with NO real-world monetary value
QuizCoins cannot be exchanged, sold, or transferred for real money
QuizCoins cannot be transferred between accounts
We may adjust QuizCoin values, earning rates, or spending rates at any time
Unused QuizCoins may expire after extended inactivity (12 months)
If your account is terminated, all QuizCoins are forfeited
QuizCoins are a license to use virtual items, not property you own
8. Enforcement and Account Termination
We enforce these Terms consistently across all four applications. Violations in one app may result in enforcement actions across all apps.
8.1 Responding to Violations
We may take the following actions when you violate these Terms:

| Harassment via phone calls | Calling privileges revoked + account suspension |
| AI abuse (generating harmful content) | AI access revoked + possible account suspension |
| Financial fraud (wallet, QuizCoins) | Account freeze + investigation + possible ban |
| Dating app misuse (catfishing, underage) | Immediate Kha ban + possible cross-app action |
8.2 Appeals
If your account is suspended or content is removed, you may appeal by contacting [email protected] within 30 days. Include:
Your account username
Which app the enforcement action was taken on
Description of the enforcement action
Explanation of why you believe the action was incorrect
Any supporting evidence
Appeals are reviewed within 48 hours. Some actions (CSAM, terrorism, illegal activity) cannot be appealed.
9. Disclaimers and Limitation of Liability
ALL QUIBIT, INC. SERVICES (QUIBIT, KHA, QUITALK, AND QUIZCOIN) ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
9.1 No Guarantee of Availability
We do not guarantee that any of our Services will always be available, uninterrupted, secure, or error-free. We may modify, suspend, or discontinue any part of any Service at any time without prior notice.
9.2 Service-Specific Disclaimers
- We do not verify the accuracy of user-posted jobs, business listings, or real estate listings
- We are not responsible for transactions between users
- Blog and post content represents user views, not Quibit, Inc. views
- We do not conduct background checks on dating users
- We do not guarantee the identity or intentions of other users
- Meeting people from online dating carries inherent risks — exercise caution
- We are not responsible for user interactions that occur offline
- AI responses may be inaccurate, incomplete, or misleading — do not rely on them for important decisions
- International phone call quality is not guaranteed and depends on network conditions
- Channel AI content is configured by channel owners, not by Quibit, Inc.
- We are not responsible for AI-generated content or advice
- Quiz content is for entertainment and education only
- Scores and rankings may be affected by technical issues
- Virtual currency may be adjusted without notice
9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIBIT, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:
Your use of or inability to use any of our Services
Any unauthorized access to or use of our servers or your data
Any AI-generated content, suggestions, or recommendations
International phone call quality, failures, or billing disputes
Any conduct of third parties on our Services (including other users)
Any content posted by other users (job listings, business profiles, dating profiles)
Offline meetings or interactions that originate from our Services
QuizCoin virtual currency value changes or loss
Our total liability shall not exceed the greater of (a) $100 or (b) the amount you paid Quibit, Inc. in the last 12 months.
9.4 Indemnification
You agree to indemnify and hold harmless Quibit, Inc. and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
Your use of any of our Services
Your violation of these Terms or any applicable law
Your content posted on any of our Services
Your interaction with other users on or off the platform
Your use of AI-generated content in ways that cause harm to third parties
10. Dispute Resolution and Arbitration
10.1 Informal Dispute Resolution
Before filing a claim, you agree to try to resolve the dispute informally by contacting [email protected]. We will try to resolve it within 60 days.
10.2 Binding Arbitration
If informal resolution fails, any dispute arising from or relating to these Terms or any Quibit, Inc. Service will be resolved through binding arbitration rather than in court, except where prohibited by law. This means:
Disputes will be resolved by a neutral arbitrator, not a judge or jury
Arbitration proceedings are generally more limited than court proceedings
Arbitrator decisions are final and binding
Right to appeal is limited
You may opt out of arbitration by sending written notice to [email protected] within 30 days of first accepting these Terms.
10.3 Class Action Waiver
YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS-WIDE ARBITRATION, OR ANY OTHER REPRESENTATIVE PROCEEDING.
11. General Provisions
11.1 Changes to Terms
We may modify these Terms at any time. Material changes will be notified via email or in-app notification at least 30 days before taking effect. Continued use of any Quibit, Inc. Service after changes indicates acceptance of the updated Terms.
11.2 Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.
11.3 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect.
11.4 Entire Agreement
These Terms, along with the Privacy Policy, Community Guidelines, Child Safety Policy, Content Policy, Moderation Policy, Data Security Policy, Safety & Security Policy, Wallet Terms, and all other policies referenced herein, constitute the entire agreement between you and Quibit, Inc. regarding use of the Services.
11.5 Assignment
You may not assign or transfer these Terms without our prior written consent. Quibit, Inc. may assign these Terms freely in connection with a merger, acquisition, or sale of assets.
11.6 Force Majeure
Quibit, Inc. is not liable for failure or delay in performance due to causes beyond our reasonable control, including natural disasters, war, terrorism, pandemics, internet outages, government actions, or infrastructure failures in Myanmar or other countries.
