1. Overview

This Business Owner Agreement ("Agreement") governs the relationship between Quibit, Inc. ("Quibit," "we," "us") and business owners ("Owner," "you") who operate a business on the Quibit Suite platform.

This Agreement supplements the Quibit Suite Terms of Service and Privacy Policy. By activating a business on Quibit Suite, you accept these additional obligations.

You Are the Data Controller

As a business owner on Quibit Suite, you are the data controller for your customers' and employees' personal data. Quibit, Inc. acts as your data processor. You bear legal responsibility for how that data is collected and used.

2. Business Registration

To activate a business on Quibit Suite, you must:

2.1 Registration Requirements

Provide accurate business name, category, and contact information

Be at least 18 years old and have legal authority to represent the business

Provide a valid business phone number and email address

Submit any verification documents requested during the approval process

Agree to these terms before your public page is approved

2.2 Approval Process

All new business registrations are reviewed by the Quibit admin team

Review typically takes 1–3 business days

We may request additional verification for regulated industries (finance, health, food)

Rejected applications receive a reason and may be resubmitted after correction

2.3 Prohibited Business Categories

Businesses selling illegal goods or services

Gambling or betting operations (without proper licensing)

Adult content businesses

Counterfeit or trademark-infringing goods

Pyramid schemes or fraudulent investment products

Businesses operating under international sanctions

Tobacco or firearms (without valid licensing and regulatory compliance)

3. Your Rights as a Business Owner

As a business owner on Quibit Suite, you have the following rights:

3.1 Data Rights

Full ownership of all business data entered into the platform

Right to export all business data at any time

Right to delete business data (subject to legal retention requirements)

Right to transfer your data to another system or provider

Right to audit which Quibit employees have accessed your data

3.2 Platform Rights

Right to customize your public page within platform guidelines

Right to define roles and permissions for your team

Right to use all features available under your subscription plan

Right to appeal platform decisions affecting your business

Right to receive advance notice of material platform changes

3.3 Support Rights

Access to business support via email and in-app help

Priority support on Pro and Business plans

Escalation path for account suspension or dispute resolution

Access to documentation, guides, and onboarding assistance

4. Your Obligations as a Business Owner

Operating a business on Quibit Suite comes with the following obligations:

4.1 Legal Compliance

Operate your business in compliance with Myanmar law and any other applicable jurisdiction

Maintain valid business licenses for your industry if required

Comply with Myanmar tax law — your POS records are your tax records

Handle employee data in compliance with applicable labor laws

Comply with consumer protection laws when dealing with customers

Notify customers of how their data is used (you are the data controller)

4.2 Platform Conduct

Maintain accurate product, pricing, and availability information on your public page

Not use the platform to mislead, defraud, or harm customers

Manage your team's access responsibly — you are liable for your team's actions

Keep your contact information and business details up to date

Respond to customer inquiries and complaints in a timely manner

4.3 Customer & Employee Data Obligations

Since you are the data controller for customer and employee data in your Suite account:

Provide customers with notice of how their data will be used

Obtain necessary consents for data collection (e.g., marketing messages)

Respond to data access and deletion requests from your customers

Inform team members that their business activity on Suite is monitored

Not use customer data collected via Suite for unrelated commercial purposes

Keep customer and employee data secure — do not share access credentials

4.4 Financial Obligations

Pay your subscription fees on time

Keep payment information current

Accurately represent transaction values in the POS system

Not use the platform to process fraudulent or unauthorized transactions

5. Multi-Branch Operations

Business owners who operate multiple locations through Quibit Suite agree to the following additional terms:

5.1 Branch Management Rules

Each branch is linked to a verified main business page

The main business owner is responsible for all branch activities

Branch managers act under delegated authority from the owner

Owners can revoke branch manager access at any time

Each branch automatically receives a private team channel and a public channel

Branch data is consolidated in the main business analytics dashboard

6. Platform Fees & Revenue

Quibit, Inc. does not take a commission on your sales. We charge flat subscription fees only:

6.1 Fee Structure

Subscription fees are charged per your selected plan (Free, Pro, Business)

Quibit, Inc. does not take a percentage of POS sales or invoices

Payment gateway fees are set and collected by the respective gateway (KBZPay, Wave, etc.)

Storage overage fees apply if you exceed your plan's quota

There are no hidden fees beyond the published subscription price

7. Business Suspension & Appeals

If your business is suspended or your public page is taken down, the following process applies:

7.1 Grounds for Suspension

Violation of Terms of Service or this Agreement

Suspected fraud or money laundering

Repeated customer complaints about deceptive practices

Non-payment of subscription fees

Provision of false business registration information

Court order or regulatory directive

7.2 Appeal Process

Receive written notice of suspension with the reason

Submit an appeal within 30 days by emailing [email protected]

Include your business name, suspension reason, and your response

We will review and respond within 10 business days

If your appeal is successful, your account is reinstated with all data intact

If your appeal is denied, you have 60 days to export your data before deletion

8. Platform Changes

We will notify business owners of material platform changes that affect their operations:

8.1 Change Notification

Feature changes: 14 days advance notice for changes that affect current workflows

Pricing changes: 30 days advance notice

Policy changes: 30 days advance notice

Security patches: applied immediately without prior notice (for your protection)

Emergency downtime: notified as soon as reasonably possible
