Terms of Service
1. Acceptance of Terms
By accessing or using Quibit Suite ("Suite," "Service," "Platform") — operated by Quibit, Inc. ("the Company," "we," "us," "our") — you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use Quibit Suite.
These Terms apply to all users of Quibit Suite: business owners, administrators, managers, staff members, and any other person granted access to a business account on the platform.
Quibit Suite is a professional business management tool. These Terms govern your use of POS, inventory, finance, team management, and customer-facing features. Please read them carefully before activating your business.
1.1 What Is Quibit Suite
Quibit Suite is an all-in-one business operating system designed for SME owners in Myanmar and the Myanmar diaspora. It includes:
- In-person and digital sales processing
- Receipt generation, refunds, and transaction history
- Support for KBZPay, Wave, AYA Pay, CB Pay, and cash
- Inventory and product catalog management
- Invoice creation and expense tracking
- Financial reporting and income analytics
- Customer and client relationship management (CRM)
- Staff invitation, role assignment, and permission control
- Task assignment, delegation, and tracking
- Internal business messaging and team channels
- Attendance and shift management (where enabled)
- Owner-controlled public page at <slug>.thequibit.com
- Customer-facing products, bookings, and contact
- Integration with Quibit and QuiTalk customer apps
1.2 Eligibility
You must be 18 years of age or older to create a business account
You must have legal authority to operate the business you register
You must provide accurate and truthful business registration information
You agree that your business complies with applicable local laws and regulations
Businesses involved in illegal activities, prohibited goods, or sanctioned industries are not eligible
2. Account & Business Responsibilities
As a business owner or account holder on Quibit Suite, you are responsible for:
2.1 Business Owner Obligations
Maintaining the security of your login credentials
All actions taken by team members you invite and grant access to
Ensuring your business complies with applicable tax, labor, and commercial laws
Accuracy of business information, pricing, and product descriptions on your public page
Obtaining appropriate consent from customers for any data you collect through Suite
Compliance with Myanmar payment regulations when using integrated payment gateways
2.2 Team Member Obligations
Using business access only for authorized business purposes
Not accessing business data outside of your assigned role
Reporting suspicious activity or unauthorized access to your employer
Keeping your credentials confidential
Not sharing your login access with others
2.3 Prohibited Uses
You may NOT use Quibit Suite to:
Process transactions for illegal goods or services
Engage in money laundering or financial fraud
Collect customer data without proper disclosure
Misrepresent your business, products, or services to customers
Use another business's page or impersonate another business
Attempt to reverse-engineer, scrape, or extract platform data beyond your own business records
Use the POS to process personal transactions unrelated to your registered business
Resell or sublicense access to Quibit Suite
3. POS & Payment Terms
Quibit Suite integrates with Myanmar-local payment gateways to enable digital payment processing. By enabling payment features, you agree to additional terms:
Quibit Suite does not process payments directly. We integrate with KBZPay, Wave Money, AYA Pay, and CB Pay. Each gateway has its own terms and fees. You are responsible for complying with their requirements.
3.1 Payment Gateway Integration
You must maintain an active account with your chosen payment gateway provider
Quibit, Inc. does not hold, move, or settle funds on your behalf
Transaction fees are charged by the payment gateway — not Quibit Suite
Refunds are processed through the original payment gateway
Disputed payments are resolved directly between you and the payment gateway provider
3.2 Transaction Records
All POS transactions are logged and retained for 7 years per legal requirements
Voided and refunded transactions remain in audit logs and cannot be deleted by staff
Only business owners and admins can void or refund transactions
Transaction records are your responsibility for tax reporting purposes
3.3 Cash Transactions
Cash sales logged in Quibit Suite POS are your internal records only
Quibit, Inc. is not responsible for cash handling discrepancies
We recommend regular cash reconciliation against POS summaries
4. Data Ownership & Responsibility
Understanding who owns and controls data on Quibit Suite is important:
4.1 You Own Your Business Data
All business records (transactions, inventory, invoices, customer lists) belong to you
Quibit, Inc. does not claim ownership of your business data
You can export all your data at any time
Closing your account does not forfeit your right to receive a data export first
4.2 Platform Data
Quibit Suite's software, features, design, and infrastructure are owned by Quibit, Inc.
Aggregated, anonymized platform usage statistics are owned by Quibit, Inc.
You may not copy, reverse-engineer, or reproduce platform functionality
4.3 Your Responsibility for Customer Data
When you collect customer information (names, contacts, purchase history) through your Quibit Suite page, you are the data controller:
You must have a lawful basis for collecting and storing customer data
You must provide customers with appropriate privacy notice
You are responsible for handling customer data requests (access, deletion, correction)
Quibit, Inc. processes customer data only on your instructions as a data processor
5. Public Business Page
Your public business page at <slug>.thequibit.com is governed by the following terms:
5.1 Page Activation & Approval
New business pages require approval from Quibit admin team before going live
Approval typically takes 1–3 business days
We may request additional verification for certain business categories
Approved pages may be suspended if they violate these Terms
5.2 Content Standards
All content on your public page must be accurate and not misleading
Product descriptions, pricing, and availability must be kept up to date
Prohibited content: adult content, violent imagery, counterfeit goods, illegal services
You are solely responsible for content your business publishes
Quibit, Inc. reserves the right to remove content that violates our policies
5.3 Branch Pages
Multi-location businesses may create branch pages linked to a main page
Each branch automatically receives its own communication channels
Branch-level managers may be assigned limited control over their branch page
The main business owner retains ultimate control over all branches
6. Team Management Terms
Quibit Suite's team management features come with specific obligations:
6.1 Inviting Staff
You may only invite real individuals who have consented to join your business platform
You must inform staff that their business activity on Suite is monitored by you as their employer
You must assign appropriate roles — over-privileged access is your responsibility
Invitations expire after 7 days if not accepted
6.2 Task & Delegation System
Tasks assigned to staff are immutable once marked completed by the assignee
Managers review and approve completed tasks
Errors in completed tasks are corrected via new redo assignments — not by modifying past records
Task history is retained permanently as part of the business audit trail
6.3 Removing Staff
Removed staff immediately lose access to all business data
Their records remain in your business history for accountability
We recommend revoking access promptly when employment ends
7. Subscription & Billing
Quibit Suite is offered on a subscription basis. Billing terms apply as follows:
7.1 Available Plans
- Basic POS, inventory, and team features
- 5 GB file storage
- Up to 3 team members
- Standard public page
- Advanced POS, full finance module, and analytics
- 50 GB file storage
- Unlimited team members
- Priority support
- All Pro features plus multi-branch management
- 250 GB file storage
- Dedicated account manager
- Custom integrations
7.2 Billing & Payment
Subscriptions are billed monthly or annually depending on your selected plan
All prices are in USD unless otherwise stated
Quibit Suite subscriptions are paid via KBZPay, Wave, AYA Pay, or CB Pay
Failed payments result in a 7-day grace period, then account downgrade
Refunds are not issued for partial months or unused features
7.3 Cancellation
You may cancel your subscription at any time from Settings > Billing
Cancellation takes effect at the end of the current billing period
Your data is retained for 90 days after cancellation — export before that window closes
Downgrading to Free Plan is available as an alternative to cancellation
8. Intellectual Property
The following intellectual property terms apply to your use of Quibit Suite:
8.1 Platform Ownership
Quibit Suite's software, design, features, and branding are owned by Quibit, Inc.
You may not copy, modify, or create derivative works from the platform
The name 'Quibit Suite,' logos, and visual design are registered trademarks of Quibit, Inc.
8.2 Your Business Content
You retain full ownership of content you create on your business page:
Product photos, descriptions, and media
Business logo and branding materials
Invoice templates and custom documents
By uploading content, you grant Quibit, Inc. a limited license to store, display, and deliver that content as part of operating the platform
9. Account Termination
Quibit Suite accounts may be terminated under the following conditions:
9.1 Termination by You
You may close your business account at any time from Settings
Export your data before closing — we retain it for 90 days post-closure
Active subscriptions should be cancelled before account closure to avoid further charges
9.2 Termination by Quibit, Inc.
Violation of these Terms of Service
Engagement in fraud, money laundering, or illegal activity
Repeated violations of content or payment policies
Non-payment of subscription fees beyond the grace period
Providing false business registration information
We will notify you before suspension except in cases of immediate legal or safety risk. You may appeal a termination decision within 30 days by contacting our support team.
9.3 Effect of Termination
Immediate loss of access to all business features
Public business page taken offline
Team members lose access automatically
Data retained for 90 days then permanently deleted
Financial records retained per legal requirements (7 years)
10. Disclaimers & Limitation of Liability
Quibit Suite is provided "as is" and "as available" without warranties of any kind, express or implied.
10.1 Service Disclaimers
We do not guarantee uninterrupted or error-free service
We are not responsible for payment gateway downtime or failures
Financial reports in Suite are for your reference — they do not constitute professional accounting or tax advice
POS functionality relies on internet connectivity — offline mode limitations apply
We are not liable for business losses arising from data entry errors, incorrect pricing, or staff misuse
10.2 Limitation of Liability
To the maximum extent permitted by law, Quibit, Inc.'s total liability to you for any claim arising from your use of Quibit Suite is limited to the amount you paid us in the 3 months preceding the claim.
We are not liable for indirect, incidental, or consequential damages
We are not liable for lost profits, lost revenue, or lost business data
We are not liable for third-party payment gateway failures
11. Governing Law & Disputes
These Terms are governed by the laws of South Korea, without regard to conflict of law principles. However, additional consumer protection laws of your jurisdiction may apply.
11.1 Dispute Resolution
We encourage resolving disputes informally first — contact us at [email protected]
If informal resolution fails, disputes will be submitted to binding arbitration
Arbitration will be conducted in Seoul, South Korea or via video hearing
Class action lawsuits and jury trials are waived to the extent permitted by law
Small claims court remains available for qualifying disputes
12. Changes to These Terms
We may update these Terms to reflect new features, legal requirements, or payment policy changes.
12.1 How We Notify You
Email to your registered business email address
In-app notification in Quibit Suite
At least 30 days' notice for material changes
Continued use after the effective date constitutes acceptance
